The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Kudhani P.S. Case No. 567 of 2019 registered for the offence punishable under Section 394 of the Indian Penal Code and Sections 25(1b), 26 and 35 of the Arms Act. The allegation is regarding two unknown miscreants having intercepted the informant and looted some cash, A.T.M. card and motorbike on pistol point, whereafter they had fled away. Subsequently, the petitioners and one co-accused namely Krishna Kumar are said to have been arrested by the Police. The learned counsel for the petitioner submits that neither any incriminating articles have been recovered from
Patna High Court CR. MISC. No.75561 of 2019(2) dt.26-11-2019 2/2 possession of the petitioner nor anything has been recovered from the house of the petitioner. The petitioner is stated to be having clean antecedent and he is languishing in custody since 29.08.2019.
Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, West, Muzaffarpur in connection with Kudhani P.S. Case No. 567 of 2019.
