This is an application for grant of anticipatory bail in connection with Parbatta PS case no. 93 of 2019 registered for the offences punishable under Sections 399, 402 of Indian Penal Code and 25(1-b)a, 26, 35 of Arms Act.
The allegation is regarding the police having received secret information that the accused persons had assembled at the house of one Sanjay Choudhary for the purposes of conspiring to commit some offence/ crime and when the police had reached there, some arms were recovered from the co-accused namely Sanjay Choudhary. It is the further allegation of the informant that the co-accused persons had managed to flee away while Sanjay Choudhary was arrested

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, no recovery of any arms has been made from him and he has got no complicity in the matter. It is further submitted that since the brother of the petitioner is Panchayat Secretary, the petitioner has been falsely implicated on account of village politics.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Parbatta PS case no. 93 of 2019 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
