The petitioner seeks bail in a case registered under Section 379/411 of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the application by order dated 24-04-2019 passed in Cr. Misc. No. 19783 of 2019 with observation "at this stage". In pursuance to the said observation, the present application has been filed for grant of bail.

Allegedly, the mobile of the petitioner was stolen away by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.76366 of 2019(2) dt.16-01-2020 2/2 petitioner is in custody since 24-01-2019. Charge sheet has already been submitted. The offences are triable by the Magistrate. There is no progress in trial of the petitioner. There is no chance of the case to be concluded in near future. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S.
