2. The petitioner seeks bail in Mansi P.S. Case No. 341/2023, registered for offence under Sections 376(D) of the Indian Penal Code.

3. It is alleged that this petitioner alongwith other two co-accused persons sexually assaulted informant and also threatened with dire consequences not to disclose the ordeal to anyone.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Specific accusation of committing rape is against coaccused Durgesh Yadav. Petitioner is in custody since 13.08.2024.

5. Learned A.P.P. for the State vehemently opposes the prayer for bail and submits that the victim, in her statement recorded under Section 164 Cr.P.C., has supported the prosecution case and stated that this petitioner brought her home and has also committed rape with her.

6. Considering the nature of accusation and statement of the informant recorded under Section 164 Cr.P.C., the prayer for bail of petitioner is rejected.
