Mr. Anish Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Barh P. S. Case No. 205 of 2018 registered for the offences punishable under Sections 302/34 of IPC and Section 27 of the Arms Act.

As per F.I.R. some miscreants have intercepted the deceased and one Arbind Mahto @ Bhagat Jee fired on him, causing arm injury. Petitioner was not named in the F.I.R. later on his name transpires on the basis of his conversation with the main accused, which appears from the case diary. Submission of the learned counsel for the petitioner is that one accused Arbind Mahto has been granted anticipatory bail, which will appear from the impugned order itself. He is in custody for three months. Charge sheet has already been submitted. He has no criminal antecedent.

No.76657 of 2019(2) dt.11-12-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. 1st, Barh, Patna, in connection with Barh P. S. Case No. 205 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
