====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 At the outset, the learned counsel for the petitioner seeks to make certain correction(s) in paragraph no. 3 of the present petition.

Permission is granted. The same be done during the course of the day.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The case of the prosecution in brief is that the petitioner along with other co-accused persons are said to have surrounded the husband of the informant, namely, Jago Rai whereafter the co-accused persons are said to have fired upon the husband of the informant, resulting in death of the husband of the informant. According to FIR, it is the co-accused persons, namely, Uday Yadav and Vijay Yadav who had fired gun shots

Patna High Court CR. MISC. No.75159 of 2019(2) dt.25-11-2019 2/2 on the husband of the informant, resulting in his death. The learned counsel for the petitioner has submitted that there is no accusation of the petitioners having either killed the husband of the informant or having committed robbery of the crops. It is further submitted that similarly situated coaccused persons have already been granted privilege of bail by a co-ordinate bench of this court, vide order, dated 23.10.2019. The petitioner is stated to be languishing in custody since 26.06.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on Regular Bail.

Accordingly, the above named petitioner is directed to be enlarged on Regular Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P. S. Case No. 62 of 2019.
