Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 447, 363, 366A, 504, 506 and 34 of the Indian Penal Code and Section 8 of POCSO Act.

Petitioner is father of co-accused-Manish Ray. Allegation against Manish Ray is of kidnapping to the daughter of the informant. The victim in her statement under Section 164 Cr.P.C. stated that she had voluntarily married with the petitioner's son.

Submission is that there is no material to substantiate that the petitioner is not going to cooperate with the trial or will

Considering the fact that there is no direct material against the petitioner who is in custody since 09.09.2019 and investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Basantpur Police Station Case No.277 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
