JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Bikram P.S. Case No. 228 of 2019 dated 21.07.2019 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

The recovery of liquor is from two other accused persons who were arrested and the implication of the petitioner in the present case is only on their confession.

The petitioner is a person of clean antecedents. Considering this aspect of the matter, learned counsel for the petitioner has urged that none of the

Patna High Court CR. MISC. No.83474 of 2019(2) dt.17-12-2019 2/2 offences under the excise law can be said to have been made out against the petitioner.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bihar Prohibition & Excise Act, 2016, Patna in connection with Bikram P.S. Case No. 228 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
