JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks regular bail in connection with Chenari P. S. Case No. 125 of 2019 registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R. the dead body of the deceased, who happens to be the wife of the petitioner was recovered from his house, having injuries on the neck.

Submission of the learned counsel for the petitioner is that he was not present at that time and witnesses have also stated so and the informant has not supported the case during the trial. He is in custody since 09.05.2019. Heard learned A.P.P. also, who has opposed the prayer for bail.

No.76038 of 2019(3) dt.18-12-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage. However, it appears that petitioner is in custody since 09.05.2019, the learned trial court is directed to expedite the trial.

With the above observations, this application is dismissed.
