The petitioner is languishing in custody in connection with Special Case No. 9469 of 2019 arising out of Parsa Bazar P.S. Case No. 400 of 2019 for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Allegation is regarding recovery of 50 litres of illicit liquor from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is in custody since 24.10.2019.
Considering the statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like
Patna High Court CR. MISC. No.75897 of 2019(2) dt.29-11-2019 2/2 amount each to the satisfaction of the learned court below where the case is pending in connection with Special Case No. 9469 of 2019 arising out of Parsa Bazar P.S. Case No. 400 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below; and (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
