Petitioner seeks bail in Pusa P.S. Case No.101 of 2016 instituted for the offence under Section(s) 394, 302 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is in custody since 20.12.2017. He is not named in the written report.

It is alleged in the written report that three unknown persons caused murder of brother of informant by fire arm. Counsel for the petitioner further submits that name of this petitioner has come during investigation in the confessional statement of co-accused. It has further been

Patna High Court Cr.Misc. No.41397 of 2018 (5) dt.05-10-2018 2/2 submitted that several other accused persons with similar allegation has been granted bail by different coordinate Benches of this Court vide Annexure-2 series.

The Sessions Judge has also mentioned in the impugned order that other co-accused has been granted bail by Hon'ble High Court. Name of the petitioner has come in the confessional statement of co-accused, Navneet Kumar @ Gunjan Kumar.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Samastipur, in connection with Pusa P.S. Case No.101 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.
