JUSTICE MADHURESH PRASAD ORAL ORDER 10-12-2019 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners are apprehending their arrest in Bounsi P.S. Case no. 276/2017 registered under sections 341, 323, 308, 504 and 506/34 of the IPC.

Counsel for the petitioners submits that petitioner nos. 1 and 2 have been allowed benefit of section 41 of the Cr.P.C. Petitioner no.3 has not been granted the same till date as he has not physically presented himself before police for availing the said benefit.

As regards petitioner no.3, he would also seek benefit of section 41 of the Cr.P.C.
