2. The petitioner has preferred this application for grant of regular bail in connection with Musrigharari P.S. Case No. 132 of 2024 dated 12.09.2024 registered for the offences punishable u/ss 126(2), 127(2), 115(2), 75, 76, 68(d), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita.

As per the prosecution case, the petitioner and the co-accused persons are alleged to have molested and the petitioner attempted to commit rape on the informant but the informant inflicted blow of blade on the private part of the petitioner causing cut injuries. It is further alleged that the informant fled away from the place of occurrence.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a doctor and he is giving his service for more than 15 years R.B.S. Multi Specialty Hospital and the said Hospital belongs to the petitioner which is under construction and the said hospital is not fully functional. The victim is a compounder and she was employed in the hospital and 7 days before the occurrence, there was some hot argument between the victim and the petitioner regarding the payment of salary, on account of the aforesaid reason, the petitioner has been made accused in this case. The petitioner has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 13.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty
