Verma, learned senior counsel for the petitioner, Mr. Mritunjay Kumar Gautam, learned APP for the State and Ms. Bela Singh, learned counsel for the informant. The petitioner seeks pre-arrest bail in connection with Town P.S. Case No. 608 of 2015 registered under Sections 302 and120B of the Indian Penal Code and Section 27 of the Arms Act.

Considering that there is no overt act alleged against the petitioner and on completion of investigation, the police submitted final report against him and differing with the police report, the learned Magistrate took cognizance of the offence, the petitioner is directed to be released on bail, in the event of
