This application for regular bail arises out of Bathnaha P.S. Case No. 83 of 2019, disclosing offences punishable under Section 302/34 of the Indian Penal Code. The F.I.R. was registered against unknown. Name of the petitioner and co-accused Arman appears to have surfaced on the basis of suspicion. Allegedly, the deceased was shot at by one of the miscreants, leading to his death on way to the hospital. Case diary has been called for. On perusal of the case diary, it appears that there is no direct material connecting the petitioner with the offence.

Mr. Vikram Deo Singh, learned counsel appearing on behalf of the petitioner has submitted that similarly

Patna High Court CR. MISC. No.75835 of 2019(4) dt.18-06-2020 2/2 circumstanced co-accused Arman has been allowed regular bail by this Court by an order dated 06.03.2020 passed in Cr. Misc. No. 77720 of 2019. On perusal of the case diary, I find substance in submission made on behalf of the petitioner that the case of the petitioner and the case of co-accused Arman are identical.

Considering the facts and circumstances, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 83 of 2019.
