Case No. 122 of 2019 registered for the offences punishable under Sections 147, 341, 323, 307, 504 and 353 of the Indian Penal Code.
As per prosecution case a child lifter was apprehended by the villagers and while police was coming they have taken him in their custody and petitioners and other accused persons assaulted the child lifter.
Submission of learned counsel for the petitioners is that though they are named in the FIR but nothing specific has been attributed against them and they are in custody for four months and charge sheet has been submitted, as such there is no
Patna High Court CR. MISC. No.74572 of 2019(2) dt.13-01-2020 2/2 chance of tampering with the evidence.
Heard learned APP also.
In view of above facts and circumstances, let petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar, Judicial Magistrate, 1st Class, Begusarai, in connection with Phulwaria P.S. Case No. 122 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
