In this case, the petitioner is seeking bail in connection with S.T. Case No.686 of 2019, arising out of Bhaptiyahi P.S. Case No.81 of 2019 registered for offence punishable under section 30(A) of the Bihar Prohibition & Excise Act.

The police received confidential information that the petitioner kept the nepali liquor under the plastic bag in the pond of Rameshwar Mukhiya and on the tip off information, the police went there and found 24.9 litres of liquor. Looking to the quantity of liquor and the petitioner have no criminal history, his prayer for bail is allowed and he in the event of arrest or surrender before the court below within six

No.77152 of 2019(2) dt.27-11-2019 2/2 weeks from today, is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Supaul in connection with S.T. Case No.686 of 2019, arising out of Bhaptiyahi P.S. Case No.81 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner would repeat the same offence in future, the prosecution will have liberty to file an application for cancellation of his bail bond.
