JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Raxaul P.S. Case No. 124 of 2019 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

As per FIR it is alleged by the informant that her minor daughter was kidnapped by one Mahesh Sah. Submission of learned counsel for the petitioner is that Mahesh Sah is his driver as such he has been made accused in this case and FIR itself shows that allegation is against Mahesh Sah and moreover statement of the victim girl was recorded under Section 164 Cr.P.C. in which she has not named any person and it is said that Mahesh Sah happens to be her uncle and he has taken her and nothing wrong has been done to her.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, East Champaran, Motihari, in connection with Raxaul P.S. Case No. 124 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
