2. The petitioner has prayed for bail in connection with Belsand P.S. Case No.112 of 2024 registered for the offence punishable under Sections 103, 61(2) and 3(5) of the Bhartiya Nyay Sanhita, 2023 and Section 27 of the Arms Act.
3. The case of the prosecution is that Rajiv Das was married to one Puja Kumari. Before marriage Rajiv Das has appeared in the examination of Bihar Police and on that instance, marriage was solemnized but Rajiv Das could not find place in the merit list. After this, Rajiv Das was being subjected to cruelty by his in-laws as he could not secure a job in police. On 14.08.2024, Rajiv Das the son of the informant has gone to his matrimonial house and that on same day his in-laws have assaulted him and
Patna High Court CR. MISC. No.85004 of 2024(3) dt.20-03-2025 2/3 after that he was shot dead. The informant believes that Puja Kumari was having illicit relation with one Sunil Das and due to which this murder has been committed.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioner is innocent and have committed no offence. They have been falsely implicated in this case. It is further submitted that in this case the occurrence is of 14.08.2024 and the F.I.R. was lodged on 16.08.2024. Inquest and postmortem was conducted on 15.08.2024 prior to the lodging of the F.I.R. Even the F.S.L. team went to the place of occurrence on 15.08.2024. During investigation, two witnesses have stated that on that day in the evening they heard hulla and when they came out of the house, they found that Rajiv Das was injured and he was being taken to hospital. They could not know as to how he was injured. The petitioner is the wife of the deceased. There is no specific allegation or material against thim.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Further, submission is that similarly situated coaccused persons have since been extended the privilege of bail vide order dated 17.03.2025 passed in Cr. Misc. No. 81767 of 2024. He is languishing in judicial custody since 17.08.2024.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.85004 of 2024(3) dt.20-03-2025 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi in connection with Belsand P.S. Case No.112 of 2024.
