The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Vishnupad P.S. Case No. 210 of 2019 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per allegation made in the F.I.R., on information
Patna High Court CR. MISC. No.75650 of 2019(2) dt.27-11-2019 2/2 being received and raid being conducted, one Kg. of Salmoniac Tablets C.C.I. Company, 10-12 plastic drums with Mahua wine etc. were recovered from Khajoor Banna.
It is submitted by learned counsel for the petitioners that nothing has been recovered from possession of the petitioners and they have no concern with the alleged recovered articles. It is further submitted that petitioners have no criminal antecedent.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners and they are directed to surrender in the court below within a period of six weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Vishnupad P.S. Case No. 210 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
