JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-03-2020 Heard learned counsel for the petitioner, counsel for the complainant and the counsel appearing for the State. The petitioner is apprehending arrest in connection with Complainant Case No. 201 (c) of 2019 for the offence under Section 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that the marriage took place on 21st July, 2017. He further submits that petitioner is ready to keep his wife with full care, honour and dignity.

Learned counsel for the informant is not in a position to make any statement on the proposal made by the counsel

Considering the fact that the petitioner is ready to keep his wife with full care, honour and dignity, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within one month from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Trial Court i.e. Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No. 201(c) of 2019, Trial No. 73 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In the event petitioner neglects, misbehaves or tortures the informant of this case, the Court below shall be at liberty to cancel the bail bond of the petitioner. (Anil Kumar Upadhyay, J) Rishi Kumar/- U T
