2. In the present case, the petitioner seeks bail in connection with Wazirganj P.S. Case No. 409 of 2014 dated 11.09.2014, registered for the offences punishable under Sections 147, 148, 149, 323, 307, 427, 435, 379 and 384 of the Indian Penal Code and Section 27 of the Arms Act and Sections 16(ii), 17 and 20 of the Unlawful Activities (Prevention) Act.
3. As per the prosecution case, a group of extremists came at the construction site where the informant has been working and demanded levi. Thereafter, they tried to set the JCB machine on fire, but their attempt was foiled by the villagers who assembled at the said place. The petitioner is stated to be one of the members of the extremist group.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.80786 of 2025(2) dt.02-12-2025 2/3 petitioner submits that petitioner has falsely been implicated in the present case and he has no involvement in the whole occurrence. The petitioner has been in Delhi all along and he has no knowledge about the present case. The petitioner was suddenly arrested by the Police on 28.08.2025. There is no specific allegation against the petitioner for any overt act. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 28.08.2025.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation and also considering the submission of chargesheet and petitioner's period of custody, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gaya / concerned Court, in connection with Wazirganj P.S. Case No. 409 of 2014, subject to the condition laid down under Section
Patna High Court CR. MISC. No.80786 of 2025(2) dt.02-12-2025 3/3 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
