Petitioner apprehends his arrest in a case registered for the offence punishable under sections 147, 148 , 149, 341 , 323 , 324, 332, 333 , 307, 353 , 355 , 379, 411 , 504 and 506 of the Indian Penal Code and u /s 27 of the Arms Act. 3 . The prosecution case in brief, is that on secret information, the informant, along with other police personnel, conducted a raid on 15.06.2024 at about 22:05 PM, and when they reached near the Goithwa river, they saw that soil and sand were transported by a JCB machine, 3 tractors were loaded with soil, and 8 tractors were empty. Thereafter, it is alleged that, on

No.86604 of 2024(4) dt.28-02-2025 2/2 seeing the police party, all the accused persons attacked the police party in order to free the seized vehicles, due to which SHO Ramshankar Singh sustained injury. It is further alleged that the accused persons took away the seized vehicle, of which this petitioner is the registered owner.
4. Considering the fact that petitioner is owner of one of the seized vehicles which was involved in illegal mining of sand and other facts and circumstances of the case , prayer for pre - arrest bail of the petitioner is hereby rejected. (Prabhat Kumar Singh, J) Koushik/- U T
