2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 308(3), 308(4), 324(4) and 61(2) of the B.N.S..

3. As per prosecution case, this petitioner is alleged to have instigated other co-accused persons to demand money and create pressure upon the hospital staff and further that if the money is not paid, they should cause damage and threaten the hospital staff.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has committed no offence. Petitioner is editor at Kelanchal Times and only as a journalist he went to cover the said incident that

Patna High Court CR. MISC. No.86355 of 2024(3) dt.28-01-2025 2/2 occurred on 30.08.2024 at 6 PM in the K.K. Nursing Home, Bhagalpur and has got no concern with the alleged occurrence. F.I.R. has been lodged after inordinate delay of five days and there is no explanation for the same. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the delay in lodging of the F.I.R., facts and circumstances of the case, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Jogsar P.S. Case No. 151 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
