Petitioners, already in custody, seek bail in connection with Garkha P.S. Case No.455 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

Allegation in brief is that in connection with dispute regarding irrigation of the field by the accused side from the pond of the informant, quarrel took place and it is alleged that Umesh Rai, Bhikhan Rai and Guddu Kumar assaulted the deceased with sword, iron rod and lathi causing his death and others assaulted others.

No.42025 of 2018(2) dt.13-07-2018 2/2 Learned counsel for the petitioners submits that prior to the present occurrence, a case was instituted by the petitioners' side against the informant and others and there is no accusation against these three petitioners regarding assaulting the deceased rather the same is specific against Umesh Rai, Bhikham Rai and Guddu Kumar and the petitioners have clean antecedent.

Having considered the aforesaid facts and circumstances, petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-XI, Saran at Chapra in connection with Garkha P.S. Case No.455 of 2017.
