The petitioner seeks regular bail in connection with Sangrampur PS case no. 213 of 2019 instituted for the offences punishable under Section 392 of Indian Penal Code. The allegation is regarding unknown accused persons having stolen motorcycle and cash from the informant of the present case.

The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner, as far as the stolen articles are concerned nor the petitioner has been put on test identification parade so as to establish his complicity in the alleged occurrence. The petitioner is said to be

Patna High Court CR. MISC. No.75160 of 2019(2) dt.28-11-2019 2/2 having a clean antecedent and he is languishing in custody since 19.09.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sangrampur PS case no. 213 of 2019.
