Petitioner is apprehending arrest in connection with Siwaipatti P.S. Case No. 109 of 2019 for the offence under sections 272, 273, 420, 34 of the Indian Penal Code and Section 30, 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 1026 liters of liquor was seized.

Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner. He has no concern with the alleged recovery. Learned counsel further submits that the petitioner is

Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from his possession, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 100000/- (One lakh) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Siwaipatti P.S. Case No. 109 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner shall deposit Rs. 100000/- (One lakh) cash to the court below and the amount deposited by the petitioner shall abide by final outcome of the pending criminal case.
