Patna High Court CWJC No.13612 of 2018 dt.01-12-2020 2/3 said illegal construction be further please to directing the respondents authority to remove the illegal construction on canal (paine) of the said work and be further please to pass an appropriate writ or writs direct or direction as your lordships may deem fit and proper."
On 20th of February, 2020 none had appeared for the petitioner when following order was passed:
"Learned counsel states that in paragraph no. 7 of the counter affidavit, respondents have clearly mentioned the execution of work being carried out, pursuant to, no objection received from the concerned authorities. Despite pass over, none has appeared on behalf of petitioner, as such the present petition needs dismissal only on merits.
List on 16.03.2020.".
Even today none appears on behalf of the present petitioner.
From the response filed by the State, it is apparent that the road is being constructed as per law under the PMJSY scheme. It appears that the present petition is motivated on account of some personal interest. The petitioner, who claims to be a social worker, has not placed on record any material to indicate any such social activity in nature carried out by him. Petition stands disposed of.
