ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 13.09.2019, in connection with Excise Case No. 319 of 2019 for the offences under Sections 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but had been hidden behind the driver seat of which the petitioner has no knowledge. It is further submitted that the petitioner has got clean antecedent. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,
