The petitioner seeks bail in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)A, 26, 27 and 35 of the Arms Act.

Learned counsel for the petitioner submits that there is no recovery of any arms from the possession of the petitioner rather it is recovered from the possession of co-accused Manish Choudhary and Prabhat Kumar Singh. He submits that similarly situated co-accused have been granted bail by coordinate Benches of this Court in Cr. Misc. No. 56257 of 2018 on 04.10.2018 and in Cr. Misc. No. 19684 of 2019 on 01.04.2019. Petitioner is languishing in judicial custody since 30.07.2019.

No.77973 of 2019(2) dt.02-12-2019 2/2 In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- cum-Sub-Judge, 15th Muzaffarpur in connection with Katra Police Station Case No. 155 of 2017.
