2. The petitioner seeks regular bail in connection with Nirmali P.S. Case No. 167 of 2023 for the offence registered under Sections 394 of the I.P.C.
3. FIR is against unknown of assaulting and committing loot with the son of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case only on the basis of confessional statement of coaccused namely Ghuran Kumar. No TIP has been conducted in this case and nothing has been recovered from the petitioner. The recovered mobile from petitioner does not belong to the victim. Petitioner has four criminal antecedent out of which two
Patna High Court CR. MISC. No.84846 of 2023(2) dt.23-01-2024 2/2 belongs to the excise and he is on bail in all the cases. Petitioner is in custody since 22.08.2023. The charge-sheet has already been submitted in this case.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Nirmali P.S.
