This application for regular bail arises out of Motipur P.S. Case No. 320 of 2019, disclosing the offences under Sections 8/20 of the N.D.P.S. Act, 1985.

Allegedly from the petitioner's possession, 1 kg. of Ganja was recovered by the Police.

Learned counsel for the petitioner has submitted that the quantity of Ganja so recovered, is much below the commercial quantity and that the petitioner has no criminal antecedent. The petitioner is in custody since 12.07.2019 in connection with the present case.

Considering the facts and circumstances and small

Patna High Court CR. MISC. No.75347 of 2019(2) dt.26-11-2019 2/2 quantity of Ganja alleged to have been recovered from possession of the petitioner, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur, in connection with Motipur P.S. Case No. 320 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
