If the petitioner surrenders and prays for regular bail before the court below within four weeks, the same shall be considered preferably on the same day without being prejudiced by the present withdrawal as this application is being withdrawn only on the ground that the petitioner has been declared an absconder and nothing is being stated on merits and the fact that the case is one under Section 498A of the IPC and the petitioner is the husband may also be considered.
