JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 This is an application for grant of anticipatory bail in connection with Bahadurpur (Sonki O.P.) P. S. Case No. 266 of 2019, disclosing offences under Sections 147, 341, 323, 325, 307, 379, 504 and 506 of IPC.

As per F.I.R. petitioners are said to have assaulted the informant and others, causing injury to them and they were taken to the D.M.C.H. for treatment. There is allegation also of snatching Mangalsutra and Rs.40,000/-.

Submission of the learned counsel for the petitioners

Patna High Court CR. MISC. No.75581 of 2019(2) dt.26-11-2019 2/2 is that there is no specific allegation has been attributed against any of them and only one injury was found on the person of Sonu Kumar, who was examined in D.M.C.H. and that has been mentioned in the impugned order also.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that injury was found to be grievous in nature.

Having heard both sides, considering the fact that there is general allegation against the petitioners and only one injury was found on the person of injured, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M., Darbhanga, in connection with Bahadurpur (Sonki O.P.) P. S. Case No. 266 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
