This application for anticipatory bail arises out of Uchakagaon P.S. Case No. 177 of 2019, disclosing the offences under Sections 341, 323, 307, 324, 379, 504 and 506/34 of the Indian Penal Code.

It is evident from the First Information Report itself that the parties are on litigating terms. There is allegation in the First Information Report of assault having been made by the petitioner No. 2 in the head of the informant with Farsa, but it is contended on behalf of the petitioners that no grievous injury has been found in the head of the informant.

No.75388 of 2019(2) dt.26-11-2019 2/2 Considering the nature of dispute which appears to be the reason behind the occurrence and nature of accusation, this application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj, in connection with Uchakagaon P.S. Case No. 177 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail Bonds shall be liable to be cancelled.
