2. The petitioner has prayed for bail in connection with Kasba P.S. Case No. 241 of 2025 registered for the offence punishable under Sections 309(4) and 3(5) of B.N.S.
3. The case of the prosecution, in short, is that two unknown miscreants have taken the bike and the cash kept in the dickey of the bike. The informant was going to deposit Rs. 3,20,000/- which was kept in his dickey. It is alleged that the petitioner is the staff of the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

Learned counsel for the petitioner has further submitted that he has been made accused on the basis of confessional statement of co-accused Md. Salil who has stated that the petitioner has given him the cash. There is also the confessional statement of this petitioner that he has handed over the cash to Md. Sahil. It is further submitted that the recovery was made from the possession of Sahil. It is also submitted that similarly situated Md. Sahil has already been granted bail by this Court vide order dated 19.01.2026 passed in Cr. Misc. No. 76381 of 2025. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 27.08.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
