The petitioner, who is in custody, seeks bail in connection with Imamganj P.S. Case No. 18 of 2018 registered for the offence punishable under Sections 364, 302, 201, 120(B)/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that petitioner has been implicated in this case on the basis of suspicion because he was one of the member of Panchayat held in village, two years prior to the occurrence in which there was a complain about his mother of being witch. There is no specific allegation against the petitioner. Charge sheet has been submitted. It has been further submitted that co-accused,
Patna High Court Cr.Misc. No.41830 of 2018(3) dt.10-09-2018 2/2 namely, Anuj Kumar has been granted bail by a co-ordinate Bench of this Court vide order dated 28.06.2018 passed in Cr. Misc. No. 36049 of 2018. Petitioner has no criminal antecedent and is in custody since 07.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya, in connection with Imamganj P.S. Case No. 18 of 2018.
