2. The petitioners seek bail in Bind P.S. case No. 74 of 2022 instituted for the offences under Sections 302 and 34 of the Indian Penal Code.

3. Prosecution allegation, in short, is that the son of the informant had gone to his in-law house (sasural) and thereafter the informant got informant got information that his son has been assaulted and killed.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been

Patna High Court CR. MISC. No.6485 of 2024(3) dt.06-03-2024 2/3 implicated in the present case. The petitioner No. 1 is father-in-law and petitioner No. 2 is mother-in-law of the deceased. There is no direct or indirect material against the petitioners to connect them in the alleged occurrence. There is no eye witness to the alleged occurrence. The petitioners have been made accused in this case only on the basis of suspicion. The petitioners are in custody since 19.07.2023 and have no criminal antecedent. While rejecting the anticipatory bail of the petitioners, a Coordinate Bench of this Court has observed that there is no specific overt act against the petitioners.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bind
