2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 103 (1) , 238 and 3 (5) of BNS.
3 . As per prosecution case , it is a specific case of the informant that all the F.I.R. named accused persons called the son of informant from her house and committed murder of him and thew the dead body in the field of one Dilip Kumar.
4. Learned counsel for the petitioner submitted that petitioner is not named in the F.I.R. The name of the petitioner transpired during course of investigation in the confessional statement of co-accused Rohan Kumar. There is no eye witness to the alleged occurrence . Only suspicion has been raised
Patna High Court CR. MISC. No.81172 of 2025(2) dt.27-11-2025 2/2 against this petitioner and he has got no concern with coaccused Rohan Kumar and the alleged occurrence . No motive has been assigned as to why this petitioner was involved in the alleged occurrence . Petitioner claims clean antecedent and is in custody since 20.05.2025 .
5 . Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, materials available on record, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM Khagaria in connection with Muffasil P. S. Case No. 67 of 2025 .
