Learned counsel for the informant is also present. Petitioner is an accused in connection with Bathnaha P.S. Case No. 302/34 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case due to ill motive and grudge. It is further submitted that the petitioner is not present at the place of occurrence. Petitioner has no criminal antecedent and he is in custody since 23.08.2019.

Learned counsel appearing on behalf of the Informant, on perusal of the case diary, submits that there is specific

Patna High Court CR. MISC. No.76802 of 2019(3) dt.05-03-2020 2/2 allegation against the petitioner that he assaulted the deceased by means of bat on the head and the cause of death was due to haemorrhage. As such, the petitioner is not entitled to the privilege of regular bail.

Having considering the entire facts and circumstances of the case and the nature of allegation, this Court is not inclined to allow the prayer for bail of the petitioner. Accordingly, prayer for grant of regular bail of the petitioner is rejected. (Arvind Srivastava, J) Jagdish/- U T
