ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 10.08.2019, in connection with Naubatpur P.S. Case No. 526 of 2019 for the offences under Sections 147, 148, 149, 188, 341, 323, 143, 333, 353, 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that the the petitioner has gone to the village where some persons had collected and had apprehended a man who was allegedly a child lifter. It is submitted that the said thief was allegedly assaulted by the mob and finally he was killed. Learned counsel for the petitioner submits that only because he was by-stander, his name was taken by co-villagers and hence he is facing prosecution. It is further submitted that except the fact that he was part of the
Patna High Court CR. MISC. No.76297 of 2019(2) dt.03-12-2019 2/2 unlawful assembly, there is no specific allegation against the petitioner in the present case. The petitioner has a clean antecedent.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur, Patna, in connection with Naubatpur P.S.
