2. The present application has been filed on behalf of the petitioner for the following reliefs:- I. For Order/Orders, direction/directions commanding and directing the Respondent concerned to conduct a free fare re-investigation of Mahila P.S. case No. 3/2021 dated 17.01.2021 instituted for the offence under section 498(A), 506 of the Indian Penal Code instituted at the instant of

2/4 one Richa Raj i.e. Respondent no.6 by Special Invigilating Agency of either Government of Bihar or Union of India.

II.For Order/Orders, direction/directions Commanding and directing the Respondents concerned to share all the materials which has came during course of investigation relaying upon which the LO. Mahila P.S. Case No. 3/2021 submitted Charge sheet against the petitioner named above in a very suspicious manner vide Charge sheet No.5/2023 dated 01.02.2023 and also to share the town location/CDR of the police persons who are involved in illegal and suspicious compliance of process under section 83 of Cr.P.C. at the petitioners Joint family house under high political influence.

III. For a direction to the learned court below for speedy trial of Kotwali Basudeopur P.S case No. 469/2019 and Kashim Bazar P.S. case No. 29/2021 instituted by the present petitioner against the Respondent no.6 and her family members by the petitioners named above.

IV. For Order/Orders, direction /directions Commanding and directing the Respondents concerned to preserve all the evidences which have been collected during course of investigation by the concerned I.O., so that reinvestigation of this instant case may be done.

3. Learned counsel for the petitioner submits that the present dispute is basically between the husband and the wife who are petitioner and respondent in this case.

He further submits that a number of litigations are pending between the parties and in this case, charge-sheet has been submitted without proper investigation and he prays that the petitioner may be permitted to move the respondent no. 02 i.e. the Superintendent of Police, Munger with a representation and if the Superintendent of Police, Munger finds substance in the representation of the petitioner, he may direct for further investigation of the case in light of the representation of the petitioner.

In view of the above, this application is disposed of with a liberty to the petitioner to file a representation before the Superintendent of Police, Munger and if he finds substance in the representation of the petitioner then he will order for further investigation of the case. The representation of the petitioner must be considered by the Superintendent of Police, Munger within one month of its filing.

6. In view of the prayer made in the writ petition, the petitioner is also given liberty to file an application for release of his household goods in the Court below and if such an

4/4 application is filed then the same shall be considered and disposed of by the Court below within one months of its filing.

7. With the aforesaid direction, this application stands disposed.

8. Let a copy of this order be communicated to the Principal District and Sessions Judge, Munger and Superintendent of Police, Munger through FAX for its compliance.
