The present application has been filed for cancellation of anticipatory bail granted to the opposite party no. 02(husband of the petitioner) vide order dated 18.09.2024 passed by the Additional District and Sessions Judge-III, Muzaffarpur in ABP No. 1036 of 2023 arising out of Sahebganj P.S. Case No. 336 of 2023 registered for the offence under Sections 498A, 323, 313, 406, 504, 307 of the Indian Penal Code on the ground that the opposite party no. 02 has obtained bail suppressing the material facts and by making false statement before the Court below.

3. Learned counsel for the petitioner has not been able

Patna High Court CR. MISC. No.1965 of 2025(2) dt.23-07-2026 2/2 to make out a case for cancellation, however, he submits that Maintenance Case No. 45 of 2024 is pending in the Court of Principal Judge, Family Court, Muzaffarpur/concerned Court below and the same is not being disposed. He also submits that the petitioner has no source of income.

In view of the above, this application is disposed of with a direction to the Principal Judge, Family Court, Muzaffarpur to conclude the proceedings of Maintenance Case No. 45 of 2024 within three months from the date of communication of a copy of this order by holding day to day hearing. He is also directed to proceed ex-parte against the noncooperating party and will send a report to this Court after three months.

5. List this case after three months under the heading "For Orders" for perusal of the report of Principal Judge, Family Court, Muzaffarpur.

6. Let a copy of this order be communicated to the Principal District and Sessions Judge, Muzaffarpur through FAX for its compliance.
