====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-12-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with S. Kamal P.S. Case No.79 of 2019 registered under Sections 147, 148, 149, 341, 307, 302 and 323 of the Indian Penal Code.

The accusation is that Batoran Choudhary, the husband of the informant Lila Devi, being the driver of the Block Development Officer, had proceeded for the government work and reached at S. Kamal Navtoliya. At that time, 17 persons, named in the F.I.R., including the petitioner surrounded the husband of the informant and, thereafter, Shivdani Ram gave the axe blow at the head of the husband of the informant. Patna High Court CR. MISC. No.80489 of 2019(2) dt.09-12-2019 2/2 that course, the nephew of the informant was also assaulted by the wife and the daughter of Dinesh Ram and Shivji Choudhary was also assaulted. Due to causing of assault, the husband of the informant died.

Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act is attributed to him. Moreover, only one injury was found on the head of the husband of the informant, which is attributed o Shivdani Ram. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with S. Kamal P.S. Case No.79 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
