The petitioner, who is in custody since 16.10.2019 seeks bail in connection with Special (Excise) Case No. 390 of 2019 (arising out of Saharsa Sadar P. S. Case No. 752 of 2019) instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.78277 of 2019(2) dt.09-12-2019 2/3 37 litres of liquor is said to have been recovered from arrested accused persons, who have named the petitioner also as one of their accomplices. The earlier cases, in which the petitioner had been made accused, are also on the basis of such extra judicial confessions.

In all the earlier cases, about which reference has been made in paragraph 3 of the bail petition, the petitioner has been granted bail.

Considering the period of custody of the petitioner and the nature of accusation against him, namely, the confession of an arrested co-accused person, the petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge, Excise Act, Saharsa in connection with Special (Excise) Case
