The petitioner seeks bail in Bidupur P.S. case no.154 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

It appears that earlier petitioner was granted provisional bail by order(s) dated 10.7.2018 and 14.8.2018 by coordinate Bench of this Court passed in Cr. Misc. no. 41637 of 2018. The petitioner was directed by order dated 14.8.2018 to surrender in the court below by 10.9.2018 and submit surrender certificate by 11.9.2018. The case was directed to be listed for admission on 12.9.2018.

Patna High Court Cr.Misc. No.41637 of 2018(5) dt.09-10-2018 2/2 The supplementary affidavit has been filed indicating that petitioner has surrendered on 10.9.2018. The petitioner has already enjoyed provisional bail twice. Therefore, this Court deem it fit that petitioner may file fresh regular bail application in court below itself.

Therefore, the instant application is disposed of with direction to the petitioner to move petition for regular bail in Court below itself which will be disposed of by court below in accordance with law on same day.
