2. The petitioner seeks bail in a case registered for the offence punishable under Sections 137(2)/96 of the BNS.
3. Petitioner is said to have kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no eye witness of this occurrence and only on the basis of suspicion, he has been made accused in this case. He submits that there is no specific overt act against the petitioner. He submits that the victim has not disclosed the name of the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application
Patna High Court CR. MISC. No.84955 of 2024(3) dt.04-04-2025 2/2 and he is languishing in judicial custody since 01.09.2024.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mashrakh P.S. Case No. 504 of 2024.
