The petitioner apprehends his arrest in connection with Rupauli P.S. Case No. 112 of 2014 for the offence punishable under Sections 379, 307 and other allied sections of the Indian Penal Code.

The allegation of the prosecution is that four persons had met with an accident and pursuant thereof, a mob had assembled, which attacked the police station and set the bus on fire caused and had damaged to the public property. It is further alleged that the said mob had also assaulted the police personnel. In the FIR 29 named accused persons are said to have been active members of the mob, apart from them 500 unknown persons are said to have attacked the police station resulting in police personnel having

The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent. Lastly, it is submitted that similarly situated accused person has already been granted anticipatory bail by a co-ordinate Bench of this Court.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner above named is directed to be released on anticipatory bail on furnishing bailbonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Rupauli P.S. Case No. 112 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) Tiwary/- U T
