2. The petitioner is apprehending his arrest in connection with Palasi P.S. Case No. 99 of 2023 for the offence under Sections 394 and 397 of the I.P.C. lodged on 05.04.2023 by the informant, Karvul Paswan.
3. As per the prosecution story, the informant alleged that while returning from Bagdogra via Thakurganj, three persons stopped the car and on the ground of death of the mother of one of them, they wanted to hire the vehicle. However, immediately thereafter on the point of knife they took away Rs. 3800/- and also wanted to snatch the vehicle. As the informant raised alarm and the villagers came, they escaped. One of them was identified as Akhtar by the villagers. Accordingly, the FIR.

4. Subsequently, Akhtar came into judicial net and on his confession, this petitioner has been named.
5. Learned APP opposes the prayer and pointed out that this petitioner is also having criminal antecedents inasmuch as three criminal cases are registered against him.
6. Considering the allegation that has come against him as also that he has three criminal antecedents, it would be appropriate that petitioner move before the concerned court for bail after his surrender within four weeks.
7. Criminal Miscellaneous No. 85873 of 2023 stands rejected.
