JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-03-2020 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioner seeks bail in Chenari P.S. Case No.149 of 2019, giving rise to POCSO Case No.57 of 2019, registered under Sections 341, 323, 354(B), 504 and 506 of the Indian Penal Code and under Sections 8 and 12 of the POCSO Act. The informant named the petitioner and other accused persons and alleged that they all tried to kidnap his daughter for the purpose of committing rape but on alarm, the accused persons fled away.

Learned counsel for the petitioner submits that on

Patna High Court CR. MISC. No.77776 of 2019(3) dt.17-03-2020 2/2 account of land dispute, false case has been lodged. Learned counsel for the informant submits that the informant went to make protest that the accused persons be restrained from making any disturbance in irrigation of the land of the informant but the police officer took the signature/thumb impression of the informant on a plain paper and converted the same into FIR. The informant never alleged that the petitioner and others eve-teased his daughter for the purpose of committing rape.

Taking into consideration the facts and nature of allegations made against the petitioner, petitioner, namely, Sunny Dewal @ Dhanji Paswan is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Sessions Judge, Rohtas at Sasaram in connection with Chenari P.S. Case No.149 of 2019, giving rise to POCSO Case No.57 of 2019.
